1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of a government entity ("User", "Investigator", "You"), and KENILGLOBAL TECH (OPC) PRIVATE LIMITED ("Company", "We", "Us", or "Our"), concerning your access to and use of the SATARK Intelligence Gateway.

If you do not agree with all of these Terms, you are expressly prohibited from using the platform and must discontinue use immediately.

2. Eligibility & Access Parameters

The SATARK platform is classified as a restricted intelligence infrastructure. Access is exclusively provisioned for:

• Serving personnel of State and Central Police Organizations in India.
• Authorized officers of Cyber Crime Cells, Anti-Terrorism Squads (ATS), and Special Operations Groups (SOG).
• Intelligence agencies operating under the mandate of the Ministry of Home Affairs (MHA), Government of India.

Identity Verification: Users must register using official government email domains (e.g., @gov.in, @police.gov.in, @nic.in). The Company reserves the right to manually verify the credentials of any user with their respective departmental headquarters before activating a terminal node.

3. Acceptable Use Policy

The tools, algorithms, and OSINT capabilities provided by SATARK must only be deployed for lawful investigative purposes in accordance with the Code of Criminal Procedure (CrPC), 1973, and the Information Technology Act, 2000.

Strict Prohibitions: You agree NOT to:

• Execute queries on individuals, phone numbers, or financial identifiers without a valid, legally sanctioned premise (e.g., an active FIR, preliminary enquiry, or official mandate).
• Share, lease, or transfer your Node Access Credentials (Username, Password, OTPs) with unauthorized personnel, civilians, or private investigative agencies.
• Attempt to reverse-engineer, decompile, or extract the proprietary source code, algorithms, or API routing methods employed by the SATARK platform.
• Utilize the platform for personal use, voyeurism, political surveillance, or any activity outside the scope of official duty.
• Deploy automated scraping bots, mass-extraction scripts, or DDoS vectors against the SATARK API endpoints.

4. Intellectual Property Rights

The SATARK Intelligence Gateway, including its UI/UX design, investigative algorithms (e.g., Fintech Reserve Engine, CDR Correlation Matrix), databases, code architecture, and the SATARK and KENILGLOBAL TECH trademarks, are the exclusive intellectual property of KENILGLOBAL TECH (OPC) PRIVATE LIMITED, conceptualized and developed by Sunil Kumar Jangid (Cyber Sunil).

The User is granted a non-exclusive, non-transferable, revocable, and limited license to access and utilize the platform solely for official law enforcement duties. No ownership rights to the software are transferred to the User or the representing Agency.

5. Confidentiality & Non-Disclosure

Due to the sensitive nature of the tools provided, the User is bound by strict confidentiality.

You agree not to publish screenshots, video recordings, workflow demonstrations, or detailed technical descriptions of the SATARK platform's internal interface or capabilities on public forums, social media, or to unauthorized media personnel. Public disclosure of SATARK's tracking methodologies jeopardizes operational security and provides tactical advantages to criminal syndicates.

6. Node Credits, Billing & Infrastructure Support

Certain advanced OSINT and fintech tracking modules within SATARK require API calls to third-party data providers. To sustain server operations and cover third-party API costs, SATARK operates on a pre-paid "Node Credit" ledger system.

• Wallet Recharges: Users or departments may inject funds into their assigned wallets via secure UPI gateways. All transactions are final, non-refundable, and exclusively utilized for system queries.
• Deductions: Credits are automatically deducted from the User's wallet upon the successful execution of premium forensic queries. The cost per query is displayed prior to execution.
• No Commercial Profit: KENILGLOBAL TECH operates SATARK as an infrastructure support initiative for LEAs. Credit deductions are formulated to cover server bandwidth, maintenance, and upstream data costs, not to generate commercial profit from law enforcement activities.

7. Limitation of Liability & Disclaimers

The SATARK platform is provided on an "AS IS" and "AS AVAILABLE" basis. While every effort is made to ensure 99.9% uptime and pinpoint accuracy, the Company makes no absolute warranties regarding uninterrupted access or the infallibility of third-party OSINT data.

Investigative Discretion: SATARK is an analytical tool designed to assist investigators; it does not replace human judgment. The Company, including its Founder, Directors, and employees, shall NOT be held liable for:

• Wrongful arrests, misidentifications, or judicial consequences arising from the User's interpretation of data generated by the platform.
• The rejection of any digital evidence by a court of law, despite the platform providing Section 65B compliant hashes.
• Loss of investigation data due to unavoidable hardware failures, though redundant backups are maintained.

8. Suspension & Termination of Uplink

The Security Operations Center (SOC) continuously monitors the platform for anomalies. We reserve the right, at our sole discretion and without prior notice, to instantly sever a node connection, lock an account, or permanently ban a user if:

• A violation of the Acceptable Use Policy is detected.
• The User's official LEA status is revoked, suspended, or cannot be verified.
• The User attempts to compromise the platform's security framework.
• We receive a direct mandate from Central Intelligence Agencies to suspend the node.

9. Governing Law & Jurisdiction

These Terms and your use of the SATARK platform are governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Jaipur, Rajasthan, India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
